The law distinguishes between commercial and non-commercial open-source software, with different treatments for each. For crypto companies, this means that wallet security is increasingly regulated like ordinary software security, reflecting a shift in how Europe views the intersection of smart-contract risk, custody risk, and cybersecurity.
